Terms of Service
Effective 3 September 2026
These Terms govern your use of PujaSathi (pujasathi.com), operated by Tracetex 360 Innovations Private Limited ("PujaSathi", "we", "us"), a company incorporated in India with its office at Durgapur, West Bengal.
By creating an account, listing a festival, or booking advertising space, you agree to these Terms. If you do not agree, do not use the platform.
1. What PujaSathi is
PujaSathi is a marketplace. We connect festival organisers ("Committees") who have on-ground advertising space with businesses ("Advertisers") who wish to sponsor it.
We are an intermediary. We do not own, control, erect or operate any pandal, banner, hoarding or festival. The advertising service itself is provided by the Committee to the Advertiser. We facilitate discovery, payment, documentation and dispute handling between them.
2. Accounts
You must be 18 or older and legally capable of entering a contract. You are responsible for the accuracy of the information you provide, for keeping your password secure, and for everything done through your account.
You may hold an Organiser account, an Advertiser account, or both. You must not create an account on behalf of a committee or business without its authority.
3. Obligations of Committees
If you list a festival you confirm that:
- You are authorised by the committee to offer its advertising space and receive payment on its behalf.
- All information — dates, location, footfall estimates, slot sizes and positions — is accurate to the best of your knowledge. Footfall figures are estimates, and you must present them as such.
- All photographs are your own committee's. Using another committee's photographs, stock images, or AI-generated images is a material breach.
- You have obtained, or will obtain, all permissions required for the festival and for displaying advertising — police, municipal, fire, electrical and any other. PujaSathi does not obtain these and is not responsible for them.
- You will display the Advertiser's branding in the agreed position, at the agreed size, for the agreed dates, and will provide proof of installation.
- Where a slot is sold as category-exclusive, you will not display a competing brand in that category at the same festival.
4. Obligations of Advertisers
- You will supply artwork or brand details by the stated deadline. Late material is your responsibility and is not a ground for refund.
- You confirm you own or are licensed to use all trademarks, logos, images and text you supply, and you indemnify us against any claim to the contrary.
- You will not supply content promoting alcohol, tobacco, betting or gambling, nor content that is obscene, defamatory, or likely to offend religious sentiment at a place of worship. Committees may decline artwork on reasonable cultural grounds.
- You will review installation proof promptly. If you do not respond within 5 days, the installation is treated as accepted.
5. Fees
Listing is free. PujaSathi charges a service fee on completed bookings, shown transparently before you confirm:
- An Advertiser fee added to the slot price.
- A Committee fee deducted from the payout.
Rates are tiered and reduce as booking value rises. The rates displayed at the time of booking apply to that booking.
6. Payments and payouts
Advertiser payments are collected by PujaSathi through a licensed payment gateway and are held, not immediately disbursed.
Committees are paid according to the Payout & Settlement Policy, which forms part of these Terms. In summary: a 50% advance is available only to committees whose KYC has been verified and approved; the balance follows verified proof of installation. Committees without verified KYC are paid in full after verified proof.
We deduct tax at source where Indian law requires it and issue the corresponding certificate.
7. Cancellations and refunds
Governed by the Refund & Cancellation Policy, which forms part of these Terms.
8. Proof of installation and disputes
Committees must upload photographic proof of installation. Advertisers may raise a dispute within 7 days of receiving it. We will review the evidence from both sides and decide within 5 working days of receiving the Committee's response. Our decision determines whether funds are released, partially refunded, or fully refunded.
Submitting proof that is not genuine — from a previous year, another venue, a stock library, or generated by software — results in immediate and permanent removal and recovery of any advance paid.
9. Prohibited conduct
You must not: misrepresent your identity or authority; list space you cannot deliver; use the platform to obtain money without providing the service; circumvent PujaSathi to avoid fees on a relationship we introduced; scrape or bulk-extract data; attempt to access another user's data; or interfere with the platform's operation.
10. Suspension and termination
We may suspend or terminate an account, remove a listing, or withhold a payout where we reasonably believe these Terms have been breached, where there is credible evidence of fraud, or where required by law. Where practical we will tell you why and what would resolve it.
You may close your account at any time. Obligations relating to bookings already made survive closure.
11. Intellectual property
You retain ownership of content you upload. You grant PujaSathi a non-exclusive, royalty-free licence to host, display and reproduce that content for the purpose of operating the platform, handling disputes, and — for listing photographs only — promoting the platform. You may withdraw the promotional permission by writing to us.
The PujaSathi name, logo, design and written content are ours and may not be copied without permission.
12. What we do not guarantee
We take reasonable care in verifying committees, but we are not the provider of the advertising service. We do not guarantee:
- Footfall, audience numbers, weather, crowd behaviour, or any commercial outcome from sponsorship.
- That a listing will receive bookings.
- Uninterrupted or error-free availability of the platform.
Verification means we checked the documents and information available to us. It is not a warranty of a committee's future conduct.
13. Limitation of liability
To the fullest extent permitted by law, our total liability in connection with any booking is limited to the amounts held or payable by us for that booking.
We are not liable for indirect, incidental, special or consequential loss, including loss of profit, revenue, goodwill or anticipated savings.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence.
14. Indemnity
You agree to indemnify PujaSathi against claims, losses and reasonable costs arising from your breach of these Terms, your content, or — in the case of a Committee — anything arising from your festival.
15. Changes
We may update these Terms. Material changes will be notified by email to registered users and by a notice on the platform at least 7 days before they take effect. Bookings already confirmed are governed by the Terms in force when they were made.
16. Governing law and disputes
These Terms are governed by the laws of India. The courts at Durgapur / Paschim Bardhaman, West Bengal have exclusive jurisdiction, subject to any non-waivable rights a consumer may have to bring proceedings elsewhere.
Before commencing proceedings, please contact our Grievance Officer so we can attempt to resolve the matter.
